The U.S. Department of Education published a final rule in the Federal Register on September 29, 2026, repealing its 2024 amendments to the Title IX regulations and restoring the regulatory text that existed before that rulemaking.

The rule, identified as document 2026-19929, takes effect on the same day it was published.

Reason for the repeal

The department states that the 2024 final rule has been vacated and is not enforceable nationwide. It says the department has not enforced the 2024 rule for over a year and a half. Because the regulatory text that existed before the 2024 rulemaking remains in force, the department is repealing the 2024 rule to update the Code of Federal Regulations accordingly.
