Key findings

Covered operators cannot knowingly use covered information to train generative AI or develop AI systems. Scope conditions include actual knowledge of K–12 use and services designed or marketed for K–12.

The operator definition excludes the education department, local education agencies and schools. General-audience exclusions also apply. Read the maintenance, development, support, improvement, diagnosis, deidentified-data and adaptive-learning provisions together.

The K–12 provisions take effect January 1, 2027. Separate higher-education provisions take effect July 1, 2027.
